Nutrition and Health Claims

Nutrition and health claims are voluntary information related to nutritional or health characteristics of foods used in commercial communications.

All statements, logos, pictures, symbols, trademarks etc. that states, suggests or implies that a food has particular nutritional or health related properties or states, suggest or implies a relationship between a food and the effect on health are considered to be nutrition or health claims.

All nutrition and health claims are EU regulated and have to comply with the Nutrition and Health Claims Regulation (1924/2006).

Furthermore, with reference to the EU provisions of food information to consumers (Regulation 1169/2011), it is not allowed to attribute to any food the property of preventing, treating or curing a human disease, nor refer to such properties.

Denmark has no additional national legislation regarding nutrition and health claims.

No possibility for pre-approval

The Agency does not have the possibility to pre-approve your company's intended claims for specific products.

Only during inspection of a product or after a complaint, can the Agency assess whether the marketing of your product complies with the claims regulation.
